Economic Insight and Bryan Cave Leighton Paisner LLP provided a joint response to the European Commission’s consultation on its draft ‘Guidelines for national courts on how to estimate the share of overcharge which was passed on to indirect purchasers and final consumers’.
We believe that, on the whole, the Commission’s guidelines offer a practical and comprehensive guide to this important issue. In addition, we offered suggestions on how the guidelines could be developed, so as to provide additional clarity for national courts.
